It's not, though. In the software industry, and some other media industries, there is precedent that if you pay for the work, you have the right to it, regardless of the contract. I am doing some more digging, but some of the "work for hire" precedents set are interesting (particularly around contract clauses which try to deny rights to own and/or license, and it goes both ways).

I don't think it's that cut and dry, and in an eight and a half billion dollar per annum industry, I'm sure there's some interesting bits out there.

Kev, the assignment of rights is clearly spelled out in the contract you sign. It's not something you need to deduce from first principles.

See, this makes for a really interesting IP case. You've hired the person to take the photographs for the express purpose of capturing the moment. With most of the precedents set, I think you could make a very, very strong argument that while you don't necessarily own the negatives, you have a right to use them as you see fit.

I will think more about this, and post my own.

Like everything else about weddings, some people are still racked with unreasoning tradition. It's part of the deal.

Do the wedding people still use analog cameras? I'd've thought that everyone would've switched over to regular cameras by now.

It varies wildly from photographer to photographer.

Some people never, ever give you then negatives. Other people sell them to you at an exorbitant price, and there's a rare subset of them that will give you your negatives as soon as they're available. Most of them will just gouge you forever.

My guy w ill give me a DVD full of the full-rez jpegs a year after the ceremony, which I view as a nice civilized compromise.

I've always been curious, but you're the first person I know getting married that's geeky enough to have a good answer --

What are the licencing terms on your wedding pics? Do you get full-rez JPEGgies?
